Terms of Use
These terms govern your use of the Strong Landscaping website. Please read them carefully. By browsing our Site or submitting a request through it, you agree to the terms below.
Acceptance of These Terms
These Terms of Use ("Terms") are an agreement between you and Strong Landscaping LLC ("Strong Landscaping," "we," "us," or "our"), a landscaping and outdoor living company based in Houston, Texas. They govern your access to and use of https://stronglandscaping.com and any content, features, and forms on it (the "Site"). By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site. If you use the Site on behalf of a business or other person, you represent that you have authority to bind them to these Terms.
About Our Site and Services
The Site provides general information about our landscaping, design, hardscaping, irrigation, lighting, and related services, and lets you request a quote. Content on the Site is for general informational purposes only and does not guarantee any particular result, price, timeline, or availability.
Submitting a quote request, and any quote, estimate, or proposal we provide, does not create a binding contract. Work begins only after we and the customer sign or otherwise agree to a separate written agreement describing the scope, price, and terms of the work. In the event of any conflict, that separate agreement controls over the Site and these Terms for the work it covers.
Acceptable Use
You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use of the Site by, anyone else. You agree that you will not:
- Use the Site in violation of any applicable law or regulation;
- Submit false, misleading, or fraudulent information, including through our forms;
- Upload or transmit viruses, malware, or any other harmful code;
- Attempt to gain unauthorized access to the Site, its servers, or any related systems;
- Use any robot, scraper, or automated means to access or collect data from the Site without our permission;
- Interfere with or disrupt the operation, security, or performance of the Site; or
- Use the Site or its content to send unsolicited advertising or to compete with us.
Intellectual Property
All content on the Site, including text, graphics, logos, the Strong Landscaping name, photographs of our projects, illustrations, page designs, and the articles on The Green Scene blog, is the property of Strong Landscaping or its licensors and is protected by United States copyright, trademark, and other laws. You may view and print pages from the Site for your own personal, non-commercial use in evaluating our services. You may not copy, reproduce, republish, distribute, modify, or create derivative works from any part of the Site without our prior written permission.
Your Submissions
When you submit information through the Site, such as a quote request, a message, or a review, you are responsible for its accuracy and for making sure you have the right to share it. You grant Strong Landscaping a non-exclusive, royalty-free license to use the content you submit for the purpose of responding to you and providing our services. Please do not submit confidential or sensitive personal information through the Site. How we handle the information you provide is described in our Privacy Policy.
Third-Party Links and Services
The Site may contain links to third-party websites and services that we do not own or control, such as our financing partner, mapping services, and social media platforms. We provide these links for your convenience only. We are not responsible for the content, products, policies, or practices of any third-party site, and a link does not mean we endorse it. Your use of a third-party site is governed by that site's own terms and privacy policy.
Communications
When you contact us or submit a request through the Site, you agree that we may communicate with you by phone, text message, and email about your request, as described in our Privacy Policy. That policy also explains how to opt out of calls, texts, and marketing emails. Consent to receive marketing calls or texts is not a condition of purchasing any service from us.
Disclaimers
The Site and all content on it are provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including the warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of viruses, or that any information on the Site is accurate, complete, or current. Any reliance you place on the Site's content is at your own risk. This section does not limit the warranties, if any, we provide in a separate signed services agreement.
Limitation of Liability
To the fullest extent permitted by Texas law, Strong Landscaping and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Site. Our total liability for any claim arising out of or relating to the Site will not exceed one hundred United States dollars ($100.00). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless Strong Landscaping and its owners, employees, and contractors from and against any claims, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of or related to your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
Governing Law and Venue
These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute that is not resolved informally will be the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.
Dispute Resolution
If a dispute arises between you and Strong Landscaping, we ask that you first contact us so we can try to resolve it informally. Most concerns can be resolved quickly this way. If we cannot resolve a dispute within a reasonable time, either party may pursue the available legal remedies in the courts identified in the "Governing Law and Venue" section above. Any claim you bring must be filed within the time period allowed by Texas law.
Changes to These Terms
We may update these Terms from time to time. When we do, we will change the "Last Updated" date above. Changes take effect when posted. Your continued use of the Site after we post an update means you accept the revised Terms, so please review this page from time to time.
Miscellaneous
These Terms, together with our Privacy Policy, are the entire agreement between you and Strong Landscaping regarding your use of the Site. If any part of these Terms is found to be unenforceable, the rest will remain in full force and effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent, but we may assign them in connection with a merger, acquisition, or sale of assets. The section headings are for convenience only.
